SEC. 5. DETENTION WITHOUT TRIAL OF UNPRIVILEGED ENEMY BELLIGERENTS.
* An individual, including a citizen of the United States, determined to be an unprivileged enemy belligerent under section 3(c)(2) in a manner which satisfies Article 5 of the Geneva Convention Relative to the Treatment of Prisoners of War may be detained without criminal charges and without trial for the duration of hostilities against the United States or its coalition partners in which the individual has engaged, or which the individual has purposely and materially supported, consistent with the law of war and any authorization for the use of military force provided by Congress pertaining to such hostilities.

That's just so dangerous! It is a PR disaster and PR is the only effective solution to terrorism -- no amount of force is effective. And it is open to abuse and prone to error. Don't the legislators learn anything from history?

I dunno if that was a realistic question or not, but I want to answer best I can anyhow.
Legislators don't do shit but what they're expected to do.
The true rulers have learned plenty from history..
Like, for example, the reason Germany failed at its attempt to take over is because it did not have the whole world in support of its mission.
We, on the other hand, have our own government, along with the rest of the world, cheering our demise.
This actually reminds me of something that has annoyed me for over a year now. Obama worked as a professor and was a lecturer in constitutional law. Why is it then, now that he has the power, that Bush, Cheney, Rice, Blair and several other isn't prosecuted to the full extent of the law for their Iraq invasion? It turns out that in fact some people/animals ARE more equal then others. I don't respect Obamas background until he actually follow the law him self and at least make sure they are tried if not convicted.
