maximum open-file limit(RHEL-as4)

It's announced that kernel-2.6 does not have fs.file-max limit.
days before, one of my resin server which running in the normal user mode generated an error mentioned that it has reached the maximum opened file limit.
after googling, It's sure that the no-max-limit is only aimed to root, my question is that when I start apache by root, how about the subprocesses' file-max, they are running at a normal user mode.

thanks for directions.
