SCOver and out?


The brief write-up HERE from Texstar's site leads to some other news regarding the SCO vs Linux case.

Apparently Novell never signed over their Unix rights to Santa Cruz Organisation (now part of SCO), but licensed them to sell Unix on their behalf, for which they got 5% commission. So Novell have demanded their other unpaid 95% which is more money than SCO have.

SCO should thank their lucky stars if they emerge from this merely civilly bankrupt. I think they have broken a number of criminal laws, and before it's over somebody might be going to jail. Maybe several somebodies. We shall see.

It's worse than that.

Even the simplest situation, "abuse of process," defines that it is a crime to attempt to use the Honorable Court as your strong-arm man.

But if it can be shown that the case was filed with claims that were known to be or should have been known to be substantially false, with the intent of damaging your competitors (duhhh-h-h-h...) then that also is a crime.

So it is literally possible that SCO's executives will be, not only justifiably bankrupt, but in prison. Deservedly so, I think.

Does this surprise anyone here? I tend to think not.

What I am wondering is: When will the SEC be jumping down Darl McBride's throat, and when is the SEC going to introduce him to his new cellmate and boyfriend "Bubba"
