strange apache errors - no htaccess...

hello.

I've compiled apache with DSO support to load the php and mod_perl modules.
I now use apache 1.3.29...

Code:
[Tue Jan 13 15:06:56 2004] [crit] [client 127.0.0.1] (13)Permission denied: /home/alex/./Documents/.htaccess pcfg_openfile: unable to check htaccess file, ensure it is readable

well, the thing is, that there is no .htaccess in that directory. it is simply world-non-readable. so apache tries to enter that directory and read the .htaccess... why? there is none?
if I set the AllowOverride option to "None" then the problem vanishes... as soon as a directory is allowed to have a htaccess then the error reoccurs.

any ideas?
