[SOLVED] Problem compiling linux kernel 2.6.35.9 on ubuntu 3.13.0-32

After making the .config with the comand make menuconfig i try to compile the kernel
but when i do that with the command make it give the following alert

How can i gave solution to this problem?

Compiling kernel 2.6.35.9 , made for like gcc-4.5.2, year ~2010.

The main compiler on your Ubuntu ?14.04? is gcc-4.<much-later>.
Do not expect 2.6.35.9 to be compiled with gcc-4.8 .
What is the purpose of kernel 2.6.35.9 ? ?

I am trying to install a patch to netem, that is NetEmCG.
But the patch is giing my problems for the installation
It gives problems patching sch_netem.c

Can you help me solving the problem with the patch?

The only one that i had problems is with the kernel, for the iproute that is inside it patch and compile with none problem
