Almost every basic utility has the same name as you'd find on AT&T UNIX. Since other programs expect those names, the names are essentially a from of API. Oracle *did* try to fight the long-standing idea that APIs could not be copyrighted (over Java), but they lost that battle with Google. I don't know if anyone has ever tried to claim that it infringed trademarks, but I'm guessing that wouldn't go over well either.
