madwifi and kernel 2.6.8

I am trying to install a wifi card using the madwifi drivers compiled from the CVS repository. It pitches an error on compilation specific to the 2.6.8 kernel. I found a patch for this issue specifically, but I don't really know how to apply it. I looked in it and it looks as though I apply it by putting it outside the madwifi directory and running the patch command. But the Patch command just stares at me blankly when I attempt to use it, I am new to patching so what am I not doing?
