rsync Vanished Files

I'm using crontab to kick off a backup script using rsync at 0130 when I check the logs in the morning I seem to get a few Code 24's
file has vanished

I check the server and the file is there, so its not being copied over to my backup server can any explain to me why this is happening.

The file concerned is bak file which is created during the day so there is not reason for it to have been modified during the time rsync creates its list to when it comes to copying it

I'd double check the rsync action time and the bak-file last modified time. Just because it 'shouldn't' have changed doesn't mean it didn't. Been caught by assumptions like that before ....
