get all the partions fine from p command now i type w to exit it and get the following error: Warring: Re-reading the partion table failed with error 16: Device or Resource Busy...........

i cant create a filesystem for hda3 mke2fs -j /dev/hda3

you may have better luck with cfdisk, although I do not think that is the peoblem. Cfdisk is very easy to use, It will just take you a couple of minutes.

I am not sure what that error is about.

no, thats not the problem... i did use it and it is much easier.... the problem i figured out is that for some reason it can't re-read the partition table (perhaps its not writting it properly??).... it wants me to reboot but that will rewen the install

I rebooted and fixed the problem.
Thanks for helping guys. ;)

you have not done much have you? You have not even made a file system, is that correct? Fdisk wants you to reboot? I sorry I am not exactly following the problem.
