setserial spd_hi (how dos and App 'request 38.4)

I have an ebookman that i'm trying to snyc...
The EBM only supports 56.7Kb... (on the serial port)
I don't have rights to change the baud rate. But I can use spd-hi... for a 'psudo' rate
the man page says '...when an applicatoin requests 38.4kbs... it will use 56.7kbs..."
How does and App 'request' 34.8kbp/

i can't change the actuall sync program, but there is a script that puts a GUi on it so i could 'request' from there. But what is the command to 'request'?
