LIRC on 2.6.8 with CVS build

Since the other fourms only users with the hauprauge(sp?) remote use lirc i'm done to this one. I have a pctv remote, LIRC says somewhere on the page that its supported and it looks like a simple homebrew one just packed with the PCTV. Well I have mythtv working so i want this to work. I compiled from cvs no prob. got my module running "lirc_serial"

lirc_dev: IR Remote Control driver registered, at major 61
lirc_serial: auto-detected active high receiver
lirc_dev: lirc_register_plugin:sample_rate: 0
That pulls up, and in /dev /dev/lircd/0 is created. mode2 -d /dev/lirc/0 but nothing shows up, i know the remote works cuz my pda can recieve the signals so the batterys arn't dead. irrecord says to check the permissions and irw does nothing then a few moments later says connection refiuesed and lircd is no longer running. any suggestions. oh and i'm running gentoo.
