Unhappy Data streaming Lucent driver problem


My previous experience with lucent driver (Suse 8.1 (kernel 2.4.18)) + binary distribution: ltmodem-kv_2.4.18_4GB-8.22a5-1.i586.rpm is excellent, I notice no problem what so ever.

But with Suse 9.2 (kernel 2.6.8) I have to 2 very serious problems that I localized as modem driver problem.
Those anyone else have been experiencing this problem like I am, or even better, if there is no problem please reply to this message so I could localized the problem.
Other localization of problem could be (MASQUARADE , kernel, interrupt, iptables (firewall))...

Problems are in data streaming:

1. If there is 2-way stream of data through modem (packet are send and receive simultaneously), both steams do not work simultaneously,
few packets (or few hundreds) are send than few (or more) packets are read,...

2. When downloading data at every 1-3 minutes, there is 6-9 seconds glitch (when it appears that modem do not receive any data),
and then in second or so two modem "receive" much more data that is physically possible (maybe all of data that missing).

I've correct problem 1 with correction in source (specifically change in heat patch code (one line) timerList.expires = jiffies+3, but problem 2 maybe demand more serious analyze of source, if it exist.

So I would like very much if anyone can confirm or denial that problem exist

My confidence that problem 2. is driver problem is shaken a little, because problem does not appear after few hours of testing. My assumption is that problem appear only when there is negotiation between my and ISP modem.

I am not convinced that this is driver problem, but even now driver problem is most probable problem localization (other alternative is that problem does not exist).

Now my assumption is:

If there is some problem with connection, modem start to negotiating about transfer speed (up stream and down stream independently), if negotiating only upstream (looking from a client side (not ISP)) what is usually the case, data are still downloading (downstream work), but modem driver (most probably) keep downloading data for itself and then in a moment when negotiation is finished transfer all kept data in the moment.

If that is the problem solution would be that data must be send immediately.
