Agere Winmodem MDP7800 busy, need setserial script


I have Suse pro 9.2, and it constantly says modem is busy. It is on dev/modem0 when i investigate through Yast2. when i use the lcpci command, it says that that its com3, ttys02. but its busy, as i said. I am quite new at linux and i know that i need to create a setserial boot script, or a symbolic link, but i don't know how. If someone could help me to create one and tell me where to put it, i would be oh so grateful and happy.
