Smile LINUX Kernal Licensing

Hi I was wondering if someone could provide me with a some information.

I want to create a small portable web server. We want to use the linux kernel for the os and we want to create our own app to serve web content.

The question is if we use the linux kernal to run the OS and run our app on top of it in memory do we have to open the source to our app since it is running on the linux kernel.

We are not against opening the source but were just need to get some more information on what we can or cant do upon completeion before we run it by the higher ups at work.

Any help would be appreciated.

Thanks

No you do not need to open source it. You can release it under any license you want -- even one that is proprietary as hell.

Now, if your product was to include SOURCE from a GPL program (like for some reason you used kernel source code IN your program) that is another matter.

But you should be fine.
