Well domain name availability doesnt really work like that, you arent going to be able to snatch a domain name by querying every 1/10 of a second to get it before others have a chance. Not how it works. And yes I can tell you that 99% of legit whois providers have a very strict net securtiy policy and will drop your IP if it sees repeated connections, most have a captcha you must use after your first two or three queries on their sites.
There is a redemption period, backordering/auctions that occur, and many other factors that go into a domain names expiration period before being released back to the pool for order.

I worked for the biggest registrar in the states and pulled out every trick I knew to try and get
www.sinister.com when it expired and was not able to obtain it as it went to a blind auction. There are too many safeguards in place to prevent people from being able to "ninja" a domain name. It happened way too often in the 90s and people got pissed when their domain name that was worth thousands of dollars got sniped by some dude who had no relation to the company and then sold it back to the company for way over its value.
