backup mail server

If I create a backup mail server, which is on a static ip, since my actual mail server is on a dynamic ip (yes I know the risk). Do I need to get a second domain name so it would work with the mx record?

No, most likely your backup is going to be something like.. in which you setup a virtual host for it or setup the domain as that, pointing your DNS to the correct IP.
