You buy it from Red Hat, latest is release 4.
If you have already purchased an earlier release, then your contract will include upgrades. https://www.redhat.com/apps/download/

If you want a free (as in beer) distro, consider Fedora.

We have purchased rhel as 3.
after that our subscription is expired.
I heard that i can download the updates in the websites(not redhat) without any guarantee. After downloading i have install using yum update. is it true?

I gather you can update RHEL from CentOS.org:
http://isoredirect.centos.org/

http://isoredirect.centos.org/centos-3/3.8/isos/i386/
... this will get you to the iso for update 8 of RHEL3

The yum repo will be:
http://isoredirect.centos.org/centos.../updates/i386/

Again, you should be using a non-commercial version. Fedora, CentOS, whitebox, for eg.

(For the i386 of course.)
