Why isn't the linux community counter suing SCO?


A question: why do you think the bigger linux players (red hat, suse, IBM) are so quite about this matter. Why don't they take action?
For example, SCO claim's that they can go after the end user. That's bull so why won't red hat (for example) sue SCO for doing unlawful harm to there business. Cos i'm hearing stories here and there that companies are getting scared of using linux.
We have to come in action. This is hurting the community. You can make fun of or be-little SCO. But the truth is they are a threat. Not because of they having an case, but because of the FUD. We should say to SCO: "put up, or shut up" . Why isn't that happening?

Personally, I think nobody is taking actions or because they don't believe SCO has a real reason or rights to do what they are trying to do... or they are really afraid. I would stick with the first option

Acknowledging SCO's claim at this point with a counter suit might backfire and draw additional attention to the case. SCO's claims are unfounded, I think the entire Linux community feels this way. We should not sink to their level. Instead, we would be better served (IMHO) to do nothing. Let SCO fling their FUD, let them shout and make acusations, let them act like a bitter 2 year old with a poopy diaper.....they may get some attention, but it is only AFTER their claims have been shown to be baseless that we should act, countersue, and bury SCO.

And personally, I believe that this will happen.

Yes, thats true, but do you know people are walking away from linux because of what SCO is doing? And then if you think that it will take years before this gets to court. Man, in that time half the compainies that are using linux now might be FUD-ed (is that a word? ) away. That's not good. By the time we win the case, we would have alraidy lost. Thats not right!

Linux's story.

Linux (Less Unix) was create by a person within the Bell Telephone Companies. Under Lisence agreements, all people can and must (if by request), have a free copy of the Binary Linux Kernal. Companies however, do hold the right to provide required fees for addition services attached to the Linux Kernal as long as, the Kernal is clearly not part of the charge.

SCOUnix (Unix OS) allows only 1 copy per computer. SCO Unix, now has a graphical user interface, which is nothing against Linux.

SCO's claimed history...

IBM was one of SCO's lisence holders when "rumors" went out that IBM induced reverse engineering and failed to secure there servers. As a result in the laps of security, information was leaked regarding vital parts of the Unix Kernal developed by SCO.

As a result, Linux (Less Unix) was developed by a representitive of a major ISP service for IBM (Bell), altered and donated freely.

SCO thus feels the right, that when IBM is proven guilty in there charges of releasing information based on the SCO UNIX kernal, all Linux developers are in direct violation of the Copy Right Law.

All front end users are thus in violation of consperisy, by aiding the violation of Copy Right Law and are in violation of Software Lisencing (1 copy per computer, you have 0 copies).


Now the facts. SCO Unix must win a lawsuit vs IBM. This must happen for there to be even a POSSIBLITY of anything they claim to happen. If the lawsuit is failed, every Linux Distributer and every Linux user has the right to sue SCO Unix for horassment.

Now why is the Linux Comunity waiting to do something? Because they don't really have too. Linux is not being charged, and companies like Red Hat, SuSE and Mandrake do not charge for Linux, they charge for services applied to it. If Linux is found to be a modified copy of Unix, the Linux Comunity just have to re-ajust there services to work with Sco Unix. If Sco Unix does not wish to follow, Microsoft will win the game putting both the Linux and the SCO Unix comunity out of business. That is one of the major two reasons why Sco Unix is working with Microsoft to help them create a new kernal. At the moment, Sco Unix is going bankrupt. Linux is better then it. Microsoft is stronger then it.

However, what if SCO fails to suceed in a lawsuit vs IBM?

Why is the Linux comunity doing nothing?

Well actually, they are doing something and something very big.
Nothing!

Why Nothing?

Because SCO is running on "very" thin ice, even after a sucessful lawsuit vs IBM.

Because while Sco is horassing the Linux Comunity, Microsoft is taking advantage of the situation, thus damaging the Linux Comunity. It is in Microsofts hope that a new kernal can be created through working with Sco. When and if SCO fails a lawsuit with IBM, every company distributing Linux, every customer using Linux, will have the right to file a lawsuit vs SCO, which has a very high chance of suceeding, since they are making it very open. The lawsuits will be so numerious, so large, and all condensed, the ScoUNIX Inc, will go bankrupt.

In reflect to this, Microsoft's only hope for creating a kernal much like Linux (which is the only major threat from Microsoft at this point) will fall down a drain. Customers that moved to Microsoft because of SCO, will end up returning to Linux. In addition, Microsoft's increase in networking prices will inspire more to leave them.

When SCO fails, Linux will impact a gigantic blow directly to Microsoft. When this blow is hit, every company currently with Microsoft will begin falling off there list into the hands of Linux. The monopoly of Microsoft could change in less then 1 year. This is why Microsoft is starting to charge monthly for there networking services, rather then yearly. They are planning a fairly large buffer incase hell knocks on there door.

It is Linux's goal to hit 2 birds with 1 stone. Sco's attempt to stay alive will be the doorway to Microsoft losing there monopoly.

Linux understand, the major threat here is not Sco, it's Microsoft.
Sco does not have a chance to destroy Linux from history, but Microsoft does.

So, what you are saying, is that if we wait for a while, we could nail both SCO and m$. Is that right? But I don't quite undersatnd how. Could you expain?

That is very correct... That is why Linux is doing nothing. Microsoft can fall into the same catagory in due time, giving Linux the ablity to hit 2 birds with 1 stone.

All they are doing right now, is letting Sco build up a bigger lawsuit for Linux to file against them "and" Microsoft.

They are letting IBM do the work. When the work is done, Linux steps in and rocks the house! <smiles>

Hi dolvmin

A few things to keep in mind when talking about SCO and UNIX history:

SCO is suing IBM for breach of contract and "misappropriation of trade secrets" reagrding SCO's assertion that IBM GPL'ed certain Enterprise Scalability Technologies such as:

NUMA - LVM - JFS - SMP

Also keep in mind that the Unix Code Lineage that SCO now has the liscence to is the AT&T Bell Labs code base - this Code base has been severely compromised in the past - many crucial concepts, methods and code elements in it were incorporated from the Berkley Sytem Distribution and were covered by that distribution when SCO got its rights.

SCO's claim that certain "methods" and "concepts" used by IBM in AIX,were esentially SCO's property, are undermined severely by the BSD link in the past amongst other things.

Regards what the Linux community can do in response - the German situation might be a useful scenario to look at.

Good on the Germans!

If this is correct, there is more to IBM's defense than one might assume from press releases.
I think everyone agrees that SCO needs to be hit with some fines pretty quick here though. That is really the only way to dismiss what they are presenting as legitimate.

German law is much tougher on companies that lie about a competitor's product than American law.

American law is very tough on publicly traded companies that mislead the investing public about the value of the company. Since SCO has begun making exaggerated claims about the value of their intellectual property the value of SCOX has risen by a factor of 9 or 10. As an investment crime what SCO has done ranks with highly hyped salted gold mines or imaginary oil deposits.

I have submitted a complaint to the SEC which focuses on SCO's stock price rise as a swindle of the investing public. SCO has convinced many investors that SCO has unlimited income potential based on their outright lies about the value of their intellectual property.

The Security Exchange Commission tends to give higher priority to investigating the scams which they receive the most complaints about. If you want to complain to the SEC go here:

Please send any evidence you can find for that to the American Securities Exchange Commission. That is a jailable offense under American law.
