UK Law - Can I apply for a refund for a unused bundled copy of WinXP from MS or Tosh?

I've not opened packaging, agreed to any MS license, etc - formatted the machine with SuSE 9.1 as soon as I turned it on. I remember a story of someone getting a refund in the US for this...


I resent paying for a MS product I will never use - PC World (the major highstreet retailer of PCs in the UK) will not supply a PC without Windows.

Furthermore, it's taken a good half hour to remove microsoft stickers from the laptop cleanly (with turps on cotton wool) - would you buy a brand new car with hard to remove sickers on the bonnet for, say, the manufacturer of the radio? I think not...

I know I can buy a laptop on-line without windows, but I should be able to go to a major store and be given real choice...


By the way, PC World use OpenOffice as their standard office package(!)

Unbelievable some of the cr@p that gets out, "seedy underbelly" indeed. IMO it's much more seedy to pre-charge for windows and then make you jump through hoops to get a refund grrrrr

When my laptop shipped with Windows XP Home, and I found out it had limited network capabilities, I called Microsoft Tech Support to see if I could upgrade it to pro or refund it. The tech told me I could send it in for a refund and gave me a refund telephone number to call for instructions. I hung up with them, and called the number. Surprise surprise, "the number you have dialed, has been disconnected". Now Windows XP Home is a coaster on my desk.

As I'm in Scotland, I liked this bit in the Reg article-


Ironically, the Scottish courts are less fussy about this, but it has yet to be tested. (Nae bather- we'll just pit the heid on them - Scottish Ed)
