BINGO! The problem as I see it is that The Social Contract in the US is only sketched out in basic terms in The Constitution and Bill of Rights. It needs to be more explicit and specific as well as updated to reflect modern conditions that couldn't be even dreamed of in 1787.

Citizens give up certain abilities, concerns and rights as payment to The Whole in return for the safety guarantees that only a large group can possibly provide and not one that can be compromised by conflict of interest. Conflict of interest is one valid reason that both Criminal and Civil Law as well as Healthcare (who doubts this after Covid?) need to be handled by Government since a private enterprise is not impartial and does routinely need to respond to conflict of interest.

We are seeing such conflict of interest wreak considerable havoc today with just one example being private, for profit, prisons. There are many more not the least of which is Big Pharma and Big Oil. I'm not 100% but I do strongly suspect the Lobby System actually needs to be completely dismantled.

Whatever else, it needs to be spelled out in clear terms.
