Etch net install kernel panic no dev/console

installing from Etch net install 2.6.8-2-i386. every thing seems to be ok. hardware is detected, partitions are good, base install completes. on the reboot to the base system

pivot_root:  no such file
/sbin/init: 432: cannot open dev/console: No such file
Krenel panic: Attempted to kill init!

earlier in the sequence sata1 and 2 both time out with this

sata1 is slow to respond, please be patient
sata1 failed to respond (30 secs)
scsi1 : sata_nv

i can boot to a knoppix cd and all partitions will mount and /dev/console is there
nf3 250gb chipset, 2x seagate 160 sata drives(not ncq), nv raid is disabled in the bios. no software raid partitions. same system has worked with fedora c4, ubuntu, mandriva, suise 9.3, and knoppix.

i havent tried the 2.4 kernel yet. is this a 2.6.8 kernel problem? anywhere i can look from the knoppix boot for a log that can give more info? or any change i need to make in grub that can get this working? any other ideas??

2.4 kernel installs and gets me into the system, but it doesnt like the nvidia nic. not good for a net install.
i have tried some of the suggestions in the 2.6 thread above but no luck.
the net install disk is 20050805, a week old. would using a newer disk help?
