ALC861 sound problem, aplay device busy with ESD

I am having problems with ALSA 1.0.14 on my Debian system. What I am trying to do is get audio working with Kismet and aplay.

This is on a Toshiba L30-10Y laptop, with Debian Lenny running on 2.6.22-2 Kernel.

ESD seems to lock the audio device, after turning it off, I can then use aplay (and also other audio programs, such as rythmbox, at the same time).

I was wondering if this was a bug or something wrong on my end? I have had a lot of problems with sound on Linux in general with this laptop. I still can't get my laptop speakers to work outside of one particular kernel. :(

I have tried running alsaconf and it doesn't really make any difference, apart from killing ESD which solves the problem anyway. This problem is not apparent on Ubuntu 7.04 or 7.10 even though they are Debian based.
