Answer to the second question: only the US FBI (or even better, the US courts, who according to the US Constitution should decide such questions) can explain more fully what the criteria are, but it seems obvious that the intent is to prevent "plain jane" netizens who just start something labeled "blog", like this one, from arguing that under the new rules an FBI agent would at least need to seek approval from a supervisor before rummaging through the author's private life.
