Legality issues?

I'm thinking of writing a (not)EIGRP for GNU/Linux.

However, I've got a concern about this because it is proprietary to Cisco.

If I make a program that interacts with real EIGRP in the same way could this be a legal concern, or am I just paranoid? I know I'd be writing it from scratch and I haven't seen any of the cisco source code, nor reverse engineered anything. But network packets are fair game to look at, correct?

In my opinion if you broadcast it then it is available for scrutiny. However, if you want solid legal advice asking a (good) lawyer is the only way to get it.
