Are you trying to use WUBI (Windows- Based Ubuntu Installer) To Install Mint 9?
This Is a Known Problem using WUBI, Please do a Google Search To find Help as it is well documented on Ubuuntu Forums, Why Not Just Dual Boot,This Problem is not with the live CD.

I guess I need to dig a little deeper, I followed the pdf. user's guide for mint 9. I am trying to set up a dual boot on a second drive. I thought Mint would load and partition the whole drive, it is un-partitioned raw data. Am I to understand I need a seperate installer to format this hard drive.

This is my first "forum" so navigating this site is a bit trying at times :-{D

I think you need to install both OS's on the same Drive- Never dual boot myself, With the price of computers I use a different computer for Windows.
The Linux Mint Forum has a how-To on dual booting--Check that Out.
When dual booting with windows,Install Windows , Then Mint (Any Linux Dirtro) As windows will rewrite the MBR
