That makes sense!

When I W i still get an error

Command (m for help): w
The partition table has been altered!

Calling ioctl() to re-read partition table.

WARNING: Re-reading the partition table failed with error 16: Device or resource busy.



the drive isnt mounted or anything

It worked!!!!

fdisk /dev/sdb did the trick.

Awesome man! I wanted to help a lot more throughout the four pages of posts, but I was kind of stumped myself. Definitely added to my mental notes...
