Having trouble with default route/gateway

Hi guys,
I am working on an issue that has been giving me some problems and it looks like it is now occuring on my replacement hardware as well. I have a server with 2 NIC's that provides service to our voip phones. 1 nic is assigned a private ip and resides on the lan. the other nic is assigned a public ip and resides on a 4 port switch that is between the ISP router and firewall wan port. All traffic usses the WAN adapters gateway to access the internet as the server has it own builtin firewall.
What I have noticed is the server is going offline frequently. I notice specifically that the config on the WAN adapter will go missing periodically. I used to be able to just add the config back in through an ifconfig statement but now that is not working anymore. If have the address assigned now with the default gw . When I try to traceroute to see what is wrong I get setsockopt SO_BINDTODEVICE: No such device

does anyone know what this means and how to get around this?

when I try to do a ifup eth1 - I receive a message back saying Error, some other host already uses address <ip addr> . Does that mean it sees the IP already in use out there and thats why it wont bring the interface up?

Ok I have been reading some other forums and I believe the firewall is performing some kind of monitoring the whole range of WAN IP's that the isp is handing us (maybe looking for rogue device). Even though the server plugged in before the firewall, the firewall must notice the arp or something. Thanks for the insight

Here is my other problem. Im guessing the server is determining this from an arp. is there a way to find out what mac address the server is observing using this ip address?
