If I kill the process it comes straight back
Plus the directory marked in red is a directory that is not on vps, when process is killed and i do a trace on the new process all is the same but the directory marked in red has changed to different numbers
Can anyone help please

The command to shutdown mysql is usually "service mysqld stop". You must do this as root or use sudo.

for anyone else reading this, its basically the Unix socket used by MySQL: see OP's post here http://www.webhostingtalk.com/showthread.php?p=6173070
