Is Apple (Darwin) GCC free as linux compartment?

I'd like to port Compiz Fusion to Darwin, but I just wanted to make sure following: Is Mac OS X or Darwin GCC completely free as in sppech?
Also, can I install Mac OS X in ext3 partitions?

Thanks

Gcc is gcc regardless of platform -- the license doesn't change. It is GPLed evetywhere. I highly doubt either Darwin or OS X supports installation on an ext3 partition. Besides, you can't (legally) install OS X on non-Apple hardware (Darwin itself, however, is BSD licensed and does not have this restriction).

Filesystem fo OS X seems to be HFS+ and only that.
