can anyone create a new distro??

Hi all,
can anyone create a new distro from a existing one with a new name?
Let me more clarify it. Someone has Redhat 9. I think source code is
available with Redhat 9,don't it?
Now, does he modify the source code (Linux source code means kernel,right?) and release a new disro with his own liberty?
Or, else h/she has to modify it under any license or agreement?

If it possible h/she might put h/her name on it as "xyz 1.0". So,RedHat 9.0
will be "xyz 1.0".

People are doing it everyday and you'll notice some of the bigger players have done the same. Mandrake spun off of Redhat originally, tons of Debian clones.. etc.
